An arrest is the use of legal authority to deprive a person of their freedom of movement. An arrest is generally made with an arrest warrant. An arrest may be made without a warrant if probable cause and exigent circumstances are presented at the time of arrest. Upon arrest, the arresting officer is responsible for the health, safety, and wellbeing of the suspect.
When arresting a suspect the following steps shall be taken:
Place the suspect in handcuffs and inform them that they are being placed under arrest.
Advise suspects of their Miranda Rights.
Offer a brief explanation as to why the person is being placed under arrest.
Conduct a search of the person to remove any weapons, contraband for seizure, or otherwise illegal items.
Conduct investigations as reasonably necessary.
